Would It Be Legal For A College Tutor To Have Sex With A Student?

If the student was 16 and the good looking tutor was just under 30? She’s married and has kids, I know it isn’t ethical, but is it legal?

Here is the correct answer – Yes it is illegal under the Sexual Offiences Act 2003 any person who has a duty of care over a person under the age of 18 is committing an offence if they have sex with that person.

Is it too difficult for people to look at the bottom of the page to see where the question originates from, or do they just assume that we’re all from the states (as there’s no life beyond it anyway)?
Anyway, It’s legal for someone who’s 16 to have sex with another person who is also at least 16 (doesn’t matter how old they are at all, as long as they’ve had their 16th birthday). But, an exception to this law is someone who is 18 or over and in a position of trust, having sex with someone who is under the age of 18.
I would assume that your college tutor is in a position of trust, just like a teacher, carer, would be. Therefore it would probably be illegal.

The answer to your question depends. Some States don’t view a Male minor having consented sex with an adult, usually over age of 21 is when it gets criminal, as statutory rape. The victim usually must be female and under 17.
But like I said before, State varies Altot even to a point couples can marry at 14.
Give a State and I’ll dig for you answer.

The law for MO regarding such matters is as follows:
566.034. 1. A person commits the crime of statutory rape in the second degree if being twenty-one years of age or older, he has sexual intercourse with another person who is less than seventeen years of age.
2. Statutory rape in the second degree is a class C felony.
Class C felony is max of 7 years in Prison. Please notice 2 things. A-It says “he” and B-It says “being twenty-one years of age or older”
That means if you’re 20 years old and doing it with someone below 17 it’s not this crime yet.
It becomes 1st degree if the person is below age of 14.

Age of consent varies by state. In most cases, no because many states will have age ranges attached to those under 18 (so at 16, it might be legal to have sex with a 19 or 20-year-old, but not a 30-year-old). Some states do have 16 (or younger) as the legal age of consent.
It’s still immoral, and definitely NOT a good idea in-so-far as not potentially ruining either of their lives, especially hers.

It is perfectly legal in the UK for those in a relationship to be ages 16 and 30 respectively.
It would be fine so long as there is no professional relationship – that is, that this tutor had no contact with this person in her professional capacity, in which case she could be guilty of abusing a position of trust.

In the UK it would be legal but it would no doubt be against the college rules and no doubt if found out the tutor would be sacked.

It’s entirely up to state law, and varies greatly. That is PROBABLY illegal, but it may not be in some states.
Many states have regulations that raises the legal age for sex when one person is in position of trust with the other..
